Minnesota's Floodproofing Regulations

What does it cover?
This chapter of the state building code regulates the construction and
alteration of buildings and structures located in a flood hazard area as
designated by flood insurance rate maps or flood hazard boundary maps. These
regulations prescribe when, if, and how buildings and structures can be
built, added to, or alternated when located in one of the specific flood
hazard areas. Essentially the provisions require that such buildings be
elevated above a specific regulatory flood datum or floodproofed in
accordance with very specific standards. In addition, optional land-use
provisions are contained that municipalities can adopt to regulate
nonconforming uses. Minnesota's Floodproofing Code consists of Floodproofing
Regulations published by the US Army Corps of Engineers and the amendments
to that document located in chapter 1335.

This chapter applies to all
jurisdictions that administer the Minnesota State Building Code.
Who enforces it?
Local building officials
and their inspectors enforce this chapter of the code. Often building
officials will work closely with their municipal engineering departments to
assist in verifying elevations and locations of flood hazard areas

official?
You should first make sure you understand what the code says about the

building official or their inspector is interpreting the applicable code
section(s). To assist you with this, you may want to research the background
of the provision(s) through your building official, staff from the
Building Codes and
Standards Division at the Department of Labor and Industry, or the staff
from the
Minnesota Department of Natural Resources Floodplain Program. If you
still disagree, you may be able to appeal the local building official's
final decision to that municipality's board of appeals. This is a group of
individuals that will meet, discuss, and vote on the matter. If that
municipality does not have a board of appeals, you can submit a request to
be heard by the State
Appeals Board. |
